A third alcohol, drug or controlled substance driving offense (3 within a lifetime) charge can result in 1 to 5 years of incarceration in the Michigan Department of Corrections, or probation with 30 days to 1 year in jail and 60 to 180 days community service. The potential fine can range from $500 - $5,000.   The court also has the authority to immobilize the vehicle or order that the vehicle be forfeited under certain circumstances. The court could also consider rehabilitative programs and order that the person complete such programs. In addition, there are driver’s license sanctions that would be imposed by the Secretary of State.
