Deferral Program Definition

A diversion program provides offenders with an alternative to the traditional criminal penalties. A person can escape a conviction in many circumstances by completing a deferred adjudication program. In federal court, the program is called “pretrial diversion.” Various programs, such as HYTA, 769.4a, and 7411 are available in Michigan courts. There is no second bite at the apple, and if you want a deferral, it is best to let an experienced lawyer advocate on your behalf. There are two types of deferral programs: (1) where a conviction is avoided entirely and (2) where a conviction is temporarily entered on the defendant’s criminal record.
