Discovery Definition

Discovery includes written, physical, or digital evidence, such as police reports, witness statements, video/audio recordings, scientific test reports, tangible physical evidence, etc. The prosecution must provide basic discovery materials to a criminal defendant before trial (and an opportunity to inspect physical evidence).

Upon request, called a Discovery Demand, the prosecution must provide additional evidence, including evidence favorable to the defendant.
