Variance Definition

A variance is a sentence imposed by a federal judge that is outside the applicable sentencing guideline range. A variance can reflect a sentence that is above or below the applicable sentencing guidelines based on facts or circumstances of a defendant’s past or the offense that were not taken into account by the statutory sentencing factors.
