Deviation Definition
A written request to a criminal prosecutor requesting a lenient plea bargain that does not conform to the charging authority’s ordinary policies and procedures. A Deviation Petition is a lengthy document that highlights the best aspects of a client’s life (employment, school, family, community service, etc.) and discusses any factual or legal weaknesses in the prosecutor’s case. Tremendous skill and strategy are required to make the Deviation Petition compelling and aggressive, but not belligerent or hostile.
