MCL 769.4a provides that a first-offense domestic violence misdemeanor can potentially be taken under advisement and dismissed if the defendant successfully completes a term of probation. A court can only grant MCL 769.4a with the prosecution’s consent after he or she consults with the alleged victim. This law enables first-time offenders facing domestic violence charges to keep their records clean.
