Battery Definition

Harmful or offensive physical contact with another person without that person’s consent. Battery is a crime that involves unwelcome physical contact, as opposed to assault, which is the act of making a person believe that such contact is imminent. A battery can occur without an assault. For example, suppose someone is unexpectedly punched in the back of the head. The victim in this scenario was the victim of a battery, but not an assault, because they didn’t know they were about to be physically contacted.
