HYTA Definition

Holmes Youthful Trainee Act (HYTA) – A law that permits a youthful offender to earn the dismissal of a criminal charge from their public record if they can successfully complete a term of probation. Beginning on October 1, 2021, HYTA is available to a defendant who committed an offense on or after their 18th birthday and before their 26th birthday. If a defendant committed the offense when they were 21 or older, a prosecutor must consent to the defendant’s HYTA status. For certain offenses, the prosecutor must also consult with the victim.
